Terms and conditions

1. General

These terms and conditions apply to all services offered by InBrandevoort, a platform that connects residents of Brandevoort with local organizations, events and initiatives.

Our services are available through the following platforms: the InBrandevoort website (inbrandevoort.nl), the InBrandevoort web app (app.inbrandevoort.nl), and the InBrandevoort mobile apps for iOS and Android. References to 'apps', 'services', or 'InBrandevoort' in these terms include all of these platforms unless otherwise specified.

2. Use of the Apps

By using our apps, you agree to these terms. You may not: (i) infringe third‑party rights (such as copyright, portrait rights, trademarks), (ii) post unlawful or misleading content, or (iii) use the apps in a way that disrupts the security or operation of the service.

3. Account and Registration

An account is required for certain features. You are responsible for keeping your login credentials confidential and for all activities that occur under your account.

You confirm that you are 18 years or older, or that you have permission from your parents/guardian to accept these terms and use our services.

In case of misuse of the apps or violation of these terms, we reserve the right to temporarily suspend or permanently block your account.

4. User Content, License & Moderation

You remain the owner of everything you post (text, images, video, audio, logos, brand names and other materials). By uploading, you grant us a non‑exclusive, transferable, sublicensable, worldwide, royalty‑free license to use, copy, distribute, display, adapt, translate and publish your content — solely to: (a) provide, secure, improve and promote our website, apps and services; (b) display and promote your content on and off our channels (newsletters, social media, partners and search engines); and (c) archive, back up and meet legal retention obligations.

This license lasts while your content is on our systems and thereafter only for backups/archives, evidence and compliance purposes, and distribution that already occurred via our channels or sublicenses, for no longer than necessary for those purposes. If your content includes recognizable persons or personal data, you confirm you obtained all required rights and permissions. You indemnify us for third‑party claims arising from your content or a breach of these representations.

We may refuse, (de)publish, label, restrict or remove content in case of (alleged) violations of rights, law or our guidelines. 5. Security & Data Protection

We implement comprehensive security measures to protect your data, including BCrypt password hashing, JWT token management, role-based access control, and extensive input validation. We monitor security events and have procedures for compromised accounts. Where applicable, we inform users about moderation decisions under the DSA with reasons and an appeal path.

You are responsible for securing your account: use strong passwords, log out on shared devices, and report suspicious activities immediately. We reserve the right to lock accounts in case of security risks.

We share data with trusted third parties for service delivery (EdenAI via OpenAI for content moderation, Google Translate for multilingual support, Resend for email delivery, Azure for file storage, Google Ads for conversion measurement on the website with your consent). All third parties operate under their standard data processing terms and maintain adequate security measures.

6. Events and Organizations

InBrandevoort facilitates the connection between residents and local organizations. We are not responsible for the quality or safety of events or activities organized by third parties.

7. Intellectual Property

All content on our apps, including texts, images, logos and software, is owned by InBrandevoort or our licensors and is protected by copyright.

8. Deletion & Anonymization

When you delete your account or request deletion, we will delete your personal data or irreversibly anonymize it, depending on the purpose. Anonymized data may be retained for statistical, reporting or security purposes, but can no longer be traced back to you. Legal retention periods may be longer.

Public contributions (such as comments and likes) and chat messages may remain visible to maintain the coherence of conversations. In that case, the personal data of the sender will be irreversibly anonymized, so that it is no longer visible who posted the contribution.

9. Liability

InBrandevoort is not liable for direct or indirect damage resulting from the use of our apps, except in case of intent or gross negligence on our part, to the extent legally permitted. We are not liable for damage caused by third parties or by the use of third-party services.

10. Changes

We reserve the right to modify these terms and conditions. Important changes will be communicated via the apps or by email.

11. Organizations and Data Processing

Organizations (clubs, associations, businesses, and other entities) that use InBrandevoort to publish content (posts, events, news) act as data controllers under the GDPR for any personal data contained in that content.

By using these features, organizations agree to the Data Processing Agreement (DPA). The DPA governs the relationship between the organization (as Controller) and InBrandevoort (as Processor) and forms an integral part of these Terms for organizations.

Organizations warrant that they have the necessary rights and consents for all content they publish, including images of identifiable individuals.

12. Applicable Law

These terms are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands (preferably Amsterdam), without prejudice to consumers’ right to bring disputes before the courts of their place of residence.
